Name on both servers

Some days ago , one player told me i have a realy nice name and i took it as a comliment. Now after learning that i must pass the dark portal to transfer to the normal realm ( i am on the hardcore one) after hitting 60 , i tried to make a new character on that one to see if my name is available....Its not..... I dont wonna change name, what will happen?? In my opinion , if sb created the character first , before anyone did , (if he is hardcore even more important) he should keep it. With my name i played on turtle wow , and any other wow. Leveling on hardcore so that sb else take my name on the normal server seems unfair for me.
